Who these terms are with
These terms are between you and Bushong Performance Systems LLC, a Tennessee limited liability company ("BPS," "I," or "we"). By using tonybushong.coach or buying a program, coaching engagement, workshop, or product from us, you agree to them. If you've signed an individual coaching agreement, that agreement governs wherever it differs from these terms.
What we offer
BPS provides coaching, workshops, facilitation, speaking, and education. Coaching is not therapy, counseling, or mental health treatment, and it is not medical, legal, financial, tax, or investment advice. If you need any of those, please work with a licensed professional. You are responsible for your own decisions and actions.
No guaranteed results
Results described on this site, including testimonials and stories, are not typical and are not a promise of what you will achieve. The earnings disclaimer in the footer of every page is part of these terms.
Payments
Prices are in US dollars and are listed on this site or in your agreement. Payments are processed by Stripe. If you choose a monthly payment plan, you are committing to the full engagement, and each scheduled payment is due on time. If a payment fails, we may pause sessions until it's resolved.
Refunds
All sales are final. See the Refund Policy.
Intellectual property
Session materials, templates, worksheets, recordings, and the content of this site belong to BPS or its licensors. You may use them for your own personal use. You may not resell, republish, record without consent, or teach them as your own without written permission. Anything you create in our work together stays yours.
Using this site
Please don't misuse the site: no attempts to break or overload it, no scraping, no sharing of paid access with people who haven't enrolled.
Limitation of liability
This site and our services are provided "as is." To the fullest extent the law allows, BPS is not liable for indirect, incidental, special, or consequential damages arising from your use of the site or our services. Our total liability for any claim is limited to the amount you paid BPS in the 12 months before the claim arose.
Governing law
These terms are governed by the laws of the State of Tennessee. Any dispute will be handled in the state or federal courts located in Tennessee.
Changes
We may update these terms. When we do, we'll change the effective date at the top of this page. Purchases are governed by the terms in place when you bought.
